The declarative act of rights review that is successful implies the reimbursement of benefits unduly received. But this reinstatement does not presuppose the review of the declarative act in any case. Both contexts are typified in the procedural and substantive rules and both of them share the same prescription period. It is clear that there are different scenarios and their application cannot be confused neither combined at convenience before administrative offices or judicial courts. The procedural term contained in the rule subordinates the exercise of the judicial action and the substantive one the temporary limit for the benefit reimbursement.
