Abstract

Constitutional Court Ruling 61/2021, of March 15, brings two novelties. On the one hand, it excludes the constitutional relevance of the qualification of the dismissal in the case of having tried to prove with evidence obtained through a violation of the employee's fundamental rights, leaving the nullity or unlawfulness in the hands of the ordinary jurisdiction. Secondly, it establishes an unavoidable obligation for the courts to rule on the amount of compensation when there is a violation of the worker's fundamental rights.
