Abstract

The European Social Charter establishes the protection of refugees by reference to the Geneva Convention and other international agreements to which States have been bound. Although the Charter conditions its protection to the formal recognition of such condition, the European Committee of Social Rights carries out an ontological interpretation, linking protection with the dignity of the person.
