This study aims to analyze the different criteria used by the Supreme Court as evidence of a double salary scale. From the outset the court made clear that the date of entry into the company alone could not justify a salary gap, but from there began to establish criteria that, if met, did allow salary differences, some object critical in this work. Indeed, the defense of collective autonomy made by courts in this matter has been left between said maximum derived from the principle of equal pay for equal work of equal value, something that deserves a reevaluation just as concluded in this study.
