Social Security for the people who serve in the family home: the incorporation of a special system in the structure of the Social Security System

Abstract

The 2012 financial year starts, with respect to the structure of the Social Security System, with the integration of two special arrangements in the General Scheme: the Special Scheme for agricultural and domestic employees.This integration, in both cases, is being developed through the introduction of a «special system» which implies a modulation of the rules of the General Scheme to bring them into line with the characteristics and peculiarities that develops the provision of services by persons integrated, and that translates into specialties you overflowing the restrictions that have operated in the establishment of special systems above, reach issues such as the determination of the contribution or the scope of protective action.

This study focuses on the integration of the Special Arrangements for the Social Security for employees of home in the General Scheme, integration, with effects of January 1, 2012, it is through the establishment of a special system whose terms and scope are fixed by the Law 27/2011, of August 1, on update, adequacy and modernization of the Social Security system (disp. additional exchange servic. 39th).

The analysis of the basic rules of integration that are contained in the Law 27/2011 constitutes the basic object of this work in which, prior to, are made some considerations on the previous Special Regime for Domestic Employees, the «tour» followed until you reach the integration in the General Scheme and the new labor regulation of special nature applied to people who provide services in the family home, given the link between the implementation of the employment relationship and the inclusion in the new special system.
