Abstract

The new General Regulation of Data Protection of the European Union recognizes the need to regulate in a specific way the balance of legitimate interests between employers and workers for the protection of data. This specific weighting must also occur between data protection and freedom of association trade unions, in order to favor the protection of the general and social interests that the unions defend. Freedom of association trade unions should be reasonably limited by the right to data protection, but data protection should also be restricted to ensure the effectiveness of freedom of association, because this collective right occupies a privileged place in the defense of the rule of law and of its democratic and social principles.
