Provision of services through collaborative consumption platforms: A new challenge for labour law

Provided by the economic crisis and the development of TICs, acquisition and provision services systems that are part of the so-called «sharing economy» have recently acquired a remarkable development. There is a significant legal uncertainty around the qualification corresponding to service providers of virtual platforms, and many technological enterprises are partnering independent contractors in fraud law. The purpose of this essay is to analyze if the legal concept of employee is enough to integrate these new ways of working, including several proposals in order to a specific future regulation of employment in the new digital environment.
