Abstract

In this decision, the Social Court No. 1 of Barcelona recognizes the right of an employee to paid leave in order to participate in an election campaign as a candidate, in accordance with the provisions for civil servants in Article 48.j) of the Basic Statute of the Public Employee and in the Order of November 6, 1985. This solution contrasts with the position defended until now by several high courts of justice.
