«Meanwhile...»: A «cosmetic» new revised text of the Statute of Workers

Abstract

The «Statute of Workers» of Spain has experienced a new regulatory process (Royal Legislative Decree 2/2015, October 23). Working relationships are subject to a growing number of legal reforms that require constant adjustment of the plurality of laws. However, the new legal text offers few notable legal developments, although it includes some have been the result of several highly controversial legislative decisions. The State Council and the Economic and Social Council of Spain have agreed to the policy of recasting of law, because the new legal text does not suffer vices of nullity. In this study we discuss the most contentious legal issues. However, the «Workers' Statute» maintains «loopholes» and many «legal contradictions» that require further review, not merely improvement «cosmetic». The real new «Spanish Workers' Statute» must recover the lost balance between the «productive function», which has been exacerbated, and «distributive function», which has been devalued.
