Abstract

The labour institution «transmission/transfer of undertakings» –that is indirectly referred to the conservation of the market economy system and directly to the workers’ protection when the companies in the benefit of which they render their services are transferred– is legally construed on the basis of industrial and post-industrial economies or state markets and, for such reason, it is not adjusted to the economic reality and should be reinvented or adjusted to the new reality of the group of companies, the «financial age» and to an economically and financially globalised system. This paper is dedicated to analyse such problem and propose solutions.
