Protection for civil servants against temporary disability and risks during pregnancy and breastfeeding

Protection for civil servants belonging to the Special Social Security Scheme for Civil Servants includes temporary disability and risk during pregnancy and breastfeeding benefits. Such protection is regulated by the codifying legislation of the Law on Social Security for Civil Servants (Royal Legislative Decree 4/2000, of 23 June) and by the General Regulation of Administrative Mutualism (Royal Decree 357/2003, of 28 March). Legal regulation was modified in 2007 and 2009 by Organic Law 3/2007, of 22 March, for the effective equality between women and men, and Law 2/2008, of 23 December, on General State Budgets for 2009. Now it is time for the statutory regulation, after the publication of Royal Decree 2/2010, of 8 January, with the aim of reorganizing some areas linked to economic benefits and its connection with the situation of temporary disability and it is also time to regulate more intensely protection against risks during pregnancy and breastfeeding. Therefore, the aim of this paper is to study the legal regime for temporary disability and risk during pregnancy and breastfeeding benefits, after its adaptation to the legislative changes produced in the past years.
