Abstract

Due to the concurrence of tactors of different kinds, the road freight transport sector has been in need of a legislative reform for years that would face some of the main economic, social and environmental challenges that were pending in terms of sustainability. In particular, it was necessary to deal with certain socio-labour problems suffered by both those who work autonomously and those who are employed by transport companies (especially those who drive) and, also, it was urgent to make significant progress in the fight against labor fraud and bad practices deployed by the so-called "mailbox companies". Moreover, in this context, it was urgent (under penalty of suffering, shortly, a large economic fine from the UE) and convenient (to address the critical difficulties of the sector) to transpose into our internal legal system the requirements of Directive (EU) 2020/1057 of the European Parliament and of the Council, of 15 July 2020, laying down specific rules with respect to Directive 96/71/EC and Directive 2014/67/EU for the posting of drivers in the sector of road transport. All these ambitious purposes are what they want to undertake with the promulgation of a regulatory battery within which the measures incorporated by Royal Decree-Laws 3, 6 and 14/2022 stand out, the first of which was published just a few days before the last strike called by carriers broke out in our country, which caused a delicate situation in the logistics and supply chain.
